A Case Study from PhD to EB-1A Green Card

Case Note: This article is a composite research case designed based on USCIS EB-1A standards. There is no fixed numerical standard under which papers, citations, peer review, or a doctoral degree automatically satisfy EB-1A.

Dr. Zhao works in medical imaging and artificial intelligence research. When he completed his PhD, he already had several papers and a certain number of citations, and he had also served as a journal reviewer. For a time, he believed that as long as he met the three categories of "papers, peer review, and original contributions," he could succeed with EB-1A. After evaluating his case, his attorney pointed out that EB-1A is not simply a matter of "checking three boxes."

USCIS uses a multi-step analysis for EB-1A. If an applicant does not have a one-time major international award, the applicant usually must first satisfy at least three categories of regulatory evidence. After that, the immigration officer will also conduct an overall final merits determination to assess whether the applicant has sustained national or international acclaim and belongs to the small percentage of people who have reached the top of the field. The applicant also needs to plan to continue working in the area of expertise.

Although Dr. Zhao's record at the time he completed his PhD might formally involve scholarly articles, judging the work of others, and original contributions, his overall impact still mainly came from his advisor's lab. He decided to first join the research team of a medical technology company in the United States and continue building independent achievements, rather than buying media coverage or accepting large numbers of low-quality review invitations just to file quickly.

In the first stage, he focused his research on improving the reliability of imaging diagnosis models for low-resource hospitals. The model he was responsible for was later tested by several partner hospitals and led to independent technical reports. Compared with ordinary paper citations, records of actual adoption can explain more concretely what impact the results produced.

In the second stage, he continued publishing research, but no longer pursued quantity alone. He kept author contribution statements, code usage data, feedback from external institutions, and independent citation materials. The case later selected several representative papers and analyzed how other teams extended his methods, rather than simply submitting a screenshot of total citations.

In the third stage, he gradually built a record of professional peer review. His early review invitations came through recommendations from his advisor. Later, journals began inviting him independently because of his public research. He kept not only the emails, but also records of the journals, number of reviews, and professional areas for the reviews he completed. Reviewing the work of others may satisfy one type of evidence, but in the final merits determination, the quality and professional context of the review work will still be considered as part of the whole.

In the fourth stage, he took on a critical role at the company. The case did not rely only on the title "Senior Scientist" to claim importance. Instead, it submitted the organizational structure, project responsibilities, leadership evaluations, and product development records to explain why his work had a substantive role for a team with a strong industry reputation.

In the fifth stage, he received professional media interviews and conference invitations. But the materials focused on why third parties paid attention to his research, rather than merely submitting paid articles. If media content only repeats a personal Resume, it may not prove sustained acclaim.

When preparing the petition, the legal team divided the evidence into two layers. The first layer corresponded to the regulatory evidence types, such as scholarly articles, peer review, original contributions, and a critical role. The second layer centered on the final merits determination, explaining how different evidence collectively showed that his acclaim was sustained, his impact was independent, and he had reached a high professional level.

The case was ultimately approved, but approval does not mean that everyone with similar numbers can succeed. Research field, citation velocity, author contribution, third-party adoption, and comparison with peers can all affect the assessment. What USCIS emphasizes is extraordinary ability and sustained acclaim, not the doctoral degree itself.

Dr. Zhao's experience can be summarized as follows: build a research foundation during the doctoral stage, expand independent impact after graduation, and apply when the evidence is mature. Some people may meet the EB-1A standard during their doctoral studies, while others may have many papers but lack major personal contributions. The questions to ask are: Which independent institutions have used my work? Why do peers invite me to review? Why is my role not replaceable? Is my acclaim sustained, rather than something that suddenly appeared right before filing?

The greatest mistake in EB-1A planning is manufacturing materials in reverse. False citations, paid awards, memberships with no threshold, and packaged media coverage may damage credibility. The truly sound path is to let immigration evidence arise naturally from professional growth: solving important problems, producing high-quality work, receiving independent recognition from peers, and continuing to work in the relevant field in the United States.
